Lender Capital LLC

Privacy Policy

Version 1.0 · Effective October 28, 2026

This policy explains what personal information Lender Capital LLC, an Arizona limited liability company ("Lender Capital", "we", "us") collects through lendercapital.co and the Lender Capital platform (the "Platform"), how we use and share it, and the choices you have. Lender Capital is a business-to-business platform: it serves private and hard money lenders and capital partners, not consumers. We do not sell personal information.

1. Whose information this covers

  • Website visitors, including people who use our calculators or read our articles.
  • Applicants and users: the people who apply for, and use, the Platform for a lender or a capital partner organization.
  • Borrowers and guarantors named in the loan files lenders and sellers submit. We receive this information from the lender, not from the borrower.
  • Business contacts at lending and investment firms that we research and contact about the Platform ("outreach contacts"), and contacts at title, escrow and servicing companies involved in a closing or sale.

2. What we collect

From applicants and users: name, title, business email and phone, organization details (legal name, entity, state, website, licenses, track record, lending or investment criteria), sign-in and two-factor records, email preferences, and the questions, messages and documents you exchange on the Platform. When you consent to electronic records or sign an agreement, we keep the consent or signature with its time, your IP address and browser details, as part of the signed record.

In loan files: what lenders and sellers submit about a loan, its property and its borrower and guarantors: names, borrowing entities, property addresses, loan terms, payment and default history, appraisals and valuations, title and closing documents, credit scores, experience and liquidity, identification and entity documents, and servicing records. We ask lenders not to submit Social Security numbers or bank details unless a document requires them. When we read a document's text, Social Security numbers, dates of birth, and bank, card, account and routing numbers are removed from the stored text, and we never store or send wire instructions: a file that contains them is flagged.

About outreach contacts: name, job title, company, business email address, business phone, public professional profile and the public web page where we found the information, whether an email address is verified as deliverable, the emails we send and your replies, and whether you asked us to stop.

Automatically: technical data needed to run and secure the Platform, such as IP address, browser and device type, pages requested and timestamps, kept in server and security logs. We use your browser's storage to keep you signed in and to remember small preferences (such as whether you have seen a guided tour). We do not use advertising cookies or cross-site tracking. Video thumbnails on our pages load from YouTube's image servers, and when you play a video, the player loads from YouTube (Google), which receives your request under its own privacy policy.

3. How we use it

  • To review applications and decide whether to approve an organization, and to keep our records of who is approved and what each organization signed.
  • To run the Platform: match loans to the capital partners whose criteria they fit, share loan files, prepare Deal Summaries, commitments, trade confirmations and closing documents, track closings, sales and servicing, and send the notices and reminders those steps need.
  • To read documents and draft text with an artificial-intelligence service, after removing sensitive values (see section 4).
  • To protect the Platform and its users: security, fraud checks (for example, unverified title companies, look-alike email domains, changed details or wire instructions), and enforcing our agreements.
  • To contact business contacts about the Platform, one email at a time from our own mailbox, and to stop when asked.
  • To comply with the law, respond to lawful requests and resolve disputes.
  • To improve the Platform, using aggregated or de-identified information where we can.

4. How we share it

  • With the other parties to a loan or sale, as the Platform works. A loan's file goes only to capital partners whose criteria it fits and who have signed the Capital Partner Platform Agreement, which carries confidentiality and non-circumvention duties; a capital partner that passes on a loan must delete its file within 30 days. Before a seller is on the Platform, prospective buyers may receive an anonymized summary with no borrower, guarantor or seller names and no street address. Lenders learn which capital partner committed to their loan. Title companies, closing attorneys and escrow agents receive what a closing or sale requires.
  • With service providers that host and operate the Platform for us under contract, and only for that purpose: database, authentication and file storage (Supabase), website hosting (Vercel), email (Google Workspace), artificial intelligence (Google Gemini, which receives text only after sensitive values are removed), and email-address verification for outreach contacts (Hunter.io).
  • For legal reasons: to comply with law, regulation, subpoena or court order, to protect rights, safety and property, and to investigate fraud.
  • In a business transfer: if Lender Capital is involved in a merger, acquisition or sale of assets, with the successor, which will remain bound by this policy for the information it receives.

We do not sell personal information, and we do not share it for cross-context behavioral advertising.

5. Borrowers and guarantors

Lender Capital does not deal with borrowers directly. A lender that submits a loan is responsible for collecting borrower and guarantor information lawfully and for giving any notices and obtaining any consents the law requires. Our agreements require every party to protect borrower information with appropriate safeguards and to report unauthorized access within 72 hours. If you are a borrower or guarantor with a question about your information, contact the lender on your loan, or us at legal@lendercapital.co.

6. Outreach contacts

We contact business people about the Platform because we believe it is relevant to their work. Every outreach email comes from a named person at Lender Capital, includes our business address, and says how to stop. If you reply asking us to stop, or opt out, we stop emailing you, and we keep your email address on a suppression list so we never email you again. You can also ask us to delete what we hold about you (section 8).

7. How long we keep it

We keep information for as long as we need it for the purposes above and as our agreements and the law require: for example, account, signature and transaction records for the life of the relationship and the periods our signed agreements set for records and claims, and outreach contacts until they opt out or we no longer need them (after an opt-out, we keep only what is needed to honor it). When we no longer need information and are not required to keep it, we delete it or de-identify it.

8. Your choices and rights

  • Access, correction and deletion. Account holders can see and update much of their information in the Platform. Anyone can ask us to access, correct or delete personal information we hold about them by emailing legal@lendercapital.co. We will verify the request and respond within the time the law requires. We may keep information we must retain by law or under a signed agreement, and will tell you if so.
  • Emails. You can turn off optional Platform emails in your email preferences, and stop outreach emails by replying or using the opt-out in the email.
  • State privacy rights. Depending on where you live, you may have additional rights, such as to know what we collect, to correct or delete it, and not to be discriminated against for exercising your rights. You may use an authorized agent. We honor these rights as the law that applies to us requires.

9. Security

We protect information with administrative, technical and physical safeguards, including encryption in transit, access controls that limit each organization to its own data, two-factor sign-in for Lender Capital administrators, redaction of sensitive values from stored document text, and logging of access and changes. No system is perfectly secure; if we learn of unauthorized access to your information, we will notify you as the law and our agreements require.

10. Children

The Platform is for businesses and is not directed to anyone under 18. We do not knowingly collect information from children.

11. Where information is processed

Lender Capital operates in the United States, and information is stored and processed in the United States.

12. Changes to this policy

We may update this policy by posting a new version with its effective date. For a material change, we will also notify account holders through the Platform or by email before it takes effect.
